Policies and Procedures

MEMBERSHIP POLICIES & CLUB RULES
FitnessWorks has designed its Membership Policies (herein "Policies") and the Club Rules (herein "Rules") to help insure a safe and enjoyable environment for all of its members. Please be thoughtful and observe the Policies and Rules as all FitnessWorks members have agreed to follow. FitnessWorks may, in its sole discretion, modify the Policies and Rules without notice at any time. It's your responsibility to know and follow the most current Policies and Rules.

The following Policies replace all previous Policies. Any conflicts between these Policies and the Rules, these Policies apply. When a Rule has a later date than the Policy in conflict, the Rule applies. All approved signs and postings within FitnessWorks premises shall be considered a part of the rules and regulations of FitnessWorks.

FITNESSWORKS EQUAL OPPORTUNITY POLICY STATEMENT
FitnessWorks seeks, enrolls, and maintains memberships without regard to race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, sexual orientation, or age. Club Policy also states that no action or circumstance undertaken by club personnel shall have the effect of discrimination on the basis of any of the aforementioned classifications. All club members shall have full and equal access to the club facility. All members with disabilities shall be entitled to reasonable accommodations for their physical and mental impairments. Any member who believes that he/she is/has been treated unfairly on any of the aforementioned matters should first report to Club Management or the owners of FitnessWorks at (805) 772-7466.

BUYER'S RIGHTS
Members understand that memberships are non-transferable, non-cancelable and non-refundable. Pro-rated refunds or pre-paid monthly dues or memberships are available only in the case of the member's death, permanent disability, or permanent relocation. Enrollment Fees and Processing Fees are non-refundable.

In the event of the members Death or Permanent Disability written verification of condition must be provided to the Club.

Permanent Relocation: Should a member move their residence more than 25 miles from the Club, payment may be suspended after acceptable written notification. This will incur a $50 cancellation fee 30 days after notification. If the member has prepaid any amount, the amount shall be refunded on a pro rate basis. The pro rate will be based upon a month-to-month cancelable membership fee in addition to a cancellation fee.

A BUYER MAY CANCEL A MEMBERSHIP AGREEMENT BY MIDNIGHT OF FITNESSWORK'S THIRD BUSINESS DAY AFTER THE DATE OF THE AGREEMENT, EXCLUDING SUNDAYS OR HOLIDAYS. SUCH CANCELLATION MUST BE IN WRITING AND SENT CERTIFIED MAIL TO FITNESSWORKS. SUCH CANCELLATION MUST BE POSTMARKED BY THE AFOREMENTIONED TIME.

MEMBERSHIP ID CARDS
FitnessWorks issues a membership ID card to you for identification purposes. You may not let anyone else use it. The ID card is FitnessWorks property and you must return it immediately if your membership is terminated or canceled. If you lose your ID card there is a $3.00 reissue fee for a new one, this fee will be waived on 1 replacement card.

CHECK-IN
You must check in at the front desk and present your membership card before you use the Facilities. If you do not have your membership card with you, you must give your full name to the Front Desk Team Member. If you do not have a photo within the DataTrak system a photo ID will be required to verify your membership and a digital photo then taken before you can use the facility.

MEMBERSHIP FREEZE POLICY
Qualification: FitnessWorks will only freeze your membership if you are in good standing with all Enrollment Fees paid and current on your Monthly Dues and you qualify as follows: All membership types may be frozen for a minimum of 2 months and a maximum of 4 months. There is a $10/month charge. If you pay for your membership on a monthly installment, you may freeze your membership by calling ABC Financial membership services at (888) 827-9262. If you have paid for your membership in full, you must come into the club and fill out a freeze information slip and attach it to your membership freeze payment.

GUEST PRIVILEGES
FitnessWorks encourages you to bring friends, relatives and business associates for a guest visit. We strongly recommend that you make an appointment for your guest's visit for a tour/orientation (call (805) 772-7466, ext. 208). A guest must check in at the front desk, be at least 18 (16 or 17 year-old minor of a parent or legal guardian who is a member is okay if the parent or legal guardian also signs release forms), fill out a "Welcome to FitnessWorks" information and waiver/release form, present a current ID, pay a guest fee and their visit must be authorized by a FitnessWorks Membership Representative before using the Facilities. FitnessWorks may restrict the number of guests and times you may bring guests. All guests must know all Policies and Rules and will be held to these procedures.

USE OF THE FACILITIES
Availability of Facilities: Any or all of the Facilities or services, including but not limited to, group fitness classes, equipment and childcare may have limited hours or may be discontinued altogether at any time and be offered on a "first come first served basis." FitnessWorks reserves the right to charge a separate participation or reservation fee for specially offered classes and for childcare services.

Conflicts Regarding Use: Please don't linger on the equipment because other members may want to use it. Allow other members to "work-in" their sets with yours while using the weight equipment. Please limit your cardio workout to 30 minutes when other members are waiting to use the machines.

If there is a sign-up list for the use of the equipment and a maximum time limit on its use, FitnessWorks expects all the members to follow the Rules. In short, observe gym etiquette. If there is a conflict over use, inform FitnessWorks management and let them resolve it.

Specialty Classes: FitnessWorks has specific procedures, rules and may charge you for attendance in special classes. Please see the front desk or read the posted information for these activities and events.

Weights & Other Equipment: There are specific Rules posted regarding the use of the weights and other equipment in the Facilities. As a courtesy, please replace the weights on the rack after you use them and wipe off any benches after your use.

Cleaning the Equipment: Please wipe down all machines after you use them with a Club Wipe. Designated cleaning stations are located throughout the gym. To help minimize waste, you can take the Club Wipe with you and use it on several pieces of equipment.

No Solicitation: FitnessWorks facilities are provided for the private use of club members only and are not open to the public. Any solicitation, not expressly sanctioned by FitnessWorks, within the club is absolutely forbidden. This includes, for example, solicitation for profit, political purposes or any other reason. This includes, but is not limited to, use of petitions, distributing or posting leaflets, notices or advertising anywhere in a club facility, or leaving multiple copies of leaflets or other papers in any club areas.

GENERAL POLICIES FOR MINORS
Please check with the front desk for specific rules, regulations and fees covering the KidWorks (childcare) and minors. You and your minor children must follow any such rules or regulations and pay any applicable fees. To join, all minors (under 18 years old) need the financial guaranty of a parent or guardian and the parent or guardian must sign the Membership Agreement.

Minors Under 14: May not use the Facilities at any time and must be accompanied by a parent or guardian at all times when in the Facilities, unless the minor is registered in KidWorks or participating in a FitnessWorks approved program. If your minor child reacts negatively or cannot behave, FitnessWorks will ask you to make other childcare arrangements. FitnessWorks does not permit children over six years old of the opposite sex in the dressing or shower rooms.

Minors 14 - 17: Must use the Facilities while accompanied by a parent or guardian and their parent or guardian signed the financial guaranty and the Membership Agreement.

LOCKERS
FitnessWorks provides lockers for day use only and suggests that you use a lock to protect your property. Do not leave any valuable property in a locker at any time. FitnessWorks is not responsible for any theft of or damage to your property. If you leave a lock on the locker overnight, FitnessWorks has the right to cut it off. FitnessWorks will consider your property abandoned if left overnight. If you leave your property overnight, FitnessWorks shall have the right to donate your property to charity.

PROHIBITED ITEMS AND ACTIVITIES
No Alcohol, Drugs, or Smoking: Members cannot use the Facilities or engage in any activity at FitnessWorks, while under the influence of illegal drugs or alcohol. Also, FitnessWorks does not permit smoking, alcohol, illegal drugs, including steroids in its Facility.

No Weapons: No weapons of any kind are permitted in FitnessWorks Facilities.

No Photographic or Video Equipment: No photography, video taping, filming or audio recording is permitted on these premises without written permission of the Management or Owners of FitnessWorks.

Strong Odors: Please avoid the use of heavy perfume or cologne and be mindful of body odor that could negatively affect another patron's workout experience.

Food & Beverages: FitnessWorks reserves the right to limit the consumption of food or beverages in workout areas.

Personal Training: Under no circumstance is any member to train another member for compensation. If it is determined that paid personal training has been conducted on the premises, the trainer and trainee will each lose their membership.

Outside Equipment: FitnessWorks reserves the right, in its sole discretion, to limit or restrict the use of outside equipment in the club.

DRESS / TOWEL POLICY
FitnessWorks requires you to wear appropriate clothing and footwear while in the Facilities. Below are general guidelines:

Footwear: Only appropriate athletic shoes may be worn. No street shoes, boots, or sandals are allowed in work out areas. In the Group Fitness & Cycling Theater only non-marking soled athletic shoes are allowed. Open toed footwear is strictly prohibited.

Clothing: All clothing must meet standards of appropriateness determined by management. Shorts, pants, sweat pants, T-shirts, tank tops, spandex, and any other accessories must be clean and free of holes that may catch on equipment or reveal an inappropriate area of the body. While using any of the fitness facilities at FitnessWorks, jean pants or jean shorts are not allowed.

CONDUCT
While in the Facility, FitnessWorks does not permit and will not tolerate any inappropriate conduct. Such conduct includes, without limitation, using loud, abusive, offensive, insulting, demeaning language, profanity, lewd conduct or any conduct that harasses or is bothersome to members or FitnessWorks employees.

VIOLATION OF RULES
Any member or guest that violates any of the Policies or Rules of FitnessWorks will be asked to stop or leave. A violation may also cause FitnessWorks to terminate the violator's membership according to the terms of their Membership Agreement.

STEROID WARNING
FitnessWorks does not tolerate the use, sale, distribution, or anyone advocating the use of illegal steroids. Anyone caught involved in the above stated activities within FitnessWorks will have their membership terminated and the appropriate authorities will be notified.

The use of steroids to increase strength or growth can cause serious health problems. Steroids can keep teenagers from growing to their full height; they can also cause heart disease, stroke, and damage liver function. Men and women using steroids may develop fertility problems, personality changes, and acne. Men can also experience premature balding and development of breast tissue. There are also civil and criminal penalties for the unauthorized sale, use, or exchange of anabolic steroids.
